If there is any discrepancy, the [Spanish version](/terminos) prevails. These Terms and Conditions (the "Terms") govern the use of the [vinciu.com](https://vinciu.com) website, the [app.vinciu.com](https://app.vinciu.com) web platform and the educational programs offered by **VinciU Inc.** ("VinciU", "we"). By accessing or using any of them, you accept these Terms. If you do not agree, do not use the service. ## 1. Definitions - **Service:** the website, the platform, the digital discipline programs (for example web development, 3D modeling, multimedia editing and robotics), lesson guides, teacher training, educational support and the family dashboard. - **School:** the school or educational organization that contracts the Service for its community. - **User:** anyone who accesses the Service: administrators, teachers, students and families enabled by the School, as well as website visitors. - **Student:** a student of the School who takes part in the programs. Students may be minors. - **Guardian:** the parent or legal guardian of a minor Student. - **Commercial agreement:** the proposal, order or contract signed between VinciU and the School that defines scope, number of users, terms and price. ## 2. Acceptance and capacity Using the Service implies accepting these Terms and the [Privacy Policy](/privacy). Anyone accepting on behalf of a School represents that they are authorized to bind it. Minor Students use the Service through their School and with the authorization of their Guardians, as described in section 6. ## 3. Changes to the Terms We may update these Terms to reflect changes in the Service or in the law. The current version is always the one published at [vinciu.com/terms](https://vinciu.com/terms), with its last updated date. If the changes are significant, we will notify Schools reasonably in advance. Continuing to use the Service after publication implies accepting the new version. ## 4. The Service VinciU offers Schools a technical and vocational education program that includes: - Digital discipline programs with content designed to prepare Students for professional life. - Access to the web platform, available 24 hours a day from any device with an internet connection. - Training so the School's teachers become facilitators of the VinciU experience in the classroom, and lesson guides. - Educational support for teachers through our contact channels. - A dashboard so families can follow Students' progress. The specific scope (disciplines, courses, number of users, terms and implementation model) is defined in the Commercial agreement with each School. If there are differences between these Terms and the Commercial agreement, the Commercial agreement prevails. Any certificate VinciU may issue for completing a program certifies participation and learning in that program and is not an official degree, nor is it endorsed by education authorities, unless expressly stated otherwise. ## 5. Accounts and access - The School decides which teachers, Students and families have access and is responsible for keeping that information up to date. - Each User must protect their credentials and not share them. If you detect unauthorized use of your account, write to [hola@vinciu.com](mailto:hola@vinciu.com). - We may suspend or close accounts that breach these Terms, with prior warning unless the seriousness of the case justifies immediate action. ## 6. Minor students The Service is designed for K-12 schools, so many Students are minors. Therefore: - Students access the Service through their School, which is responsible for obtaining the Guardians' authorization for the processing of their data, as set out in the [Privacy Policy](/privacy). - Families can follow Students' progress from their dashboard and may request access to, correction or deletion of their data at any time. - VinciU does not use Students' data for advertising purposes. ## 7. Contracting and payments Prices, payment method, invoicing and renewal or cancellation conditions are set out in the Commercial agreement with each School. Using the platform has no additional cost for teachers, Students and families, unless the Commercial agreement provides otherwise. ## 8. Acceptable use When using the Service you agree not to: - Use it for unlawful, offensive or discriminatory purposes or in ways that affect the rights of others. - Send unsolicited bulk messages (spam) or collect other Users' data for that purpose. - Attempt unauthorized access to accounts, systems or data, or interfere with the operation of the Service. - Copy, resell or distribute the content beyond what section 9 allows. ## 9. Intellectual property The content, courses, guides, images, trademarks, trade names and software of the Service belong to VinciU or their respective owners. The contract grants the School and its Users a limited, non-exclusive and non-transferable license to use them for educational purposes within the School and for the term of the Commercial agreement. Downloading, reproducing, modifying, selling or distributing them beyond that use requires VinciU's prior written permission. Work and projects created by Students belong to them. VinciU may only show or share them with the corresponding authorization (see section 10). ## 10. Image and testimonials VinciU will only use Users' names, images, voices, testimonials or work in promotional materials with express authorization. For minor Students, that authorization must be given by their Guardian. The authorization can be withdrawn at any time by writing to [hola@vinciu.com](mailto:hola@vinciu.com). ## 11. Technical requirements Using the platform requires a device with an up-to-date web browser and a stable internet connection. VinciU is not responsible for failures in Users' devices, software or connection. ## 12. Availability, warranties and liability We work to keep the Service available continuously, but there may be interruptions for maintenance, updates or reasons beyond VinciU's control. The Service is provided "as is" and, to the extent permitted by law, VinciU does not warrant that it is error-free and is not liable for indirect damages arising from its use. The website may include links to third-party services (for example, Google Calendar to book a demo), which are governed by their own terms. Nothing in these Terms limits the rights that applicable consumer protection law grants Users. ## 13. Personal data The processing of personal data is governed by the [Privacy Policy](/privacy), which forms part of these Terms. ## 14. Governing law and jurisdiction These Terms are governed by the laws of the Argentine Republic. In case of any dispute, the parties submit to the ordinary courts of the city of San Juan, Argentina, unless applicable law provides for another jurisdiction or the Commercial agreement states otherwise. ## 15.
